1. Acceptance of Terms
By accessing, browsing, or using AI Attorney ("Service", "Platform", "We", "Us", or "Our"), you ("User", "You", or "Your") accept and agree to be bound by these Terms of Service ("Terms"), our Privacy Policy, and all applicable laws and regulations. If you do not agree to these Terms, you are prohibited from using or accessing this Service.
THESE TERMS CONTAIN A BINDING ARBITRATION CLAUSE AND CLASS ACTION WAIVER THAT AFFECT YOUR RIGHTS. PLEASE READ SECTION 18 CAREFULLY.
2. Service Description and Legal Disclaimer
AI Attorney provides AI-powered legal document generation services using proprietary multi-AI verification systems, including our CrossCheck™ technology and Precedent Monitor™ intelligence features. Our Platform uses artificial intelligence (Claude, Grok, and other AI models) to create legal documents based on user inputs and responses to interview questions.

- AI Attorney does NOT provide legal advice and is NOT a law firm
- We are NOT a substitute for an attorney licensed in your jurisdiction
- All documents are for informational and educational purposes only
- You MUST have documents reviewed by a qualified attorney before use in legal proceedings
- Use of our Service does NOT create an attorney-client relationship
- AI-generated content may contain errors, omissions, or inaccuracies
3. Intellectual Property Rights and Restrictions
3.1 Our Proprietary Rights
All content, features, functionality, trademarks, service marks, and technology on the Platform, including but not limited to:
- CrossCheck™ Multi-AI Verification System (trademark pending)
- Precedent Monitor™ intelligence features (trademark pending)
- AI algorithms, prompts, workflows, and verification methodologies
- Document templates, citation databases, and legal frameworks
- Software code, APIs, databases, and technical infrastructure
- User interface designs, graphics, logos, and trade dress
- Training data, AI model configurations, and proprietary datasets
are owned by AI Attorney or our licensors and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws.
3.2 Strict Usage Restrictions
You are expressly PROHIBITED from:
- Reverse Engineering: Decompiling, disassembling, reverse engineering, or attempting to derive source code, algorithms, or trade secrets from our Platform
- Automated Access: Using bots, scrapers, crawlers, or any automated tools to access, copy, or extract data from our Platform
- Competitive Intelligence: Accessing the Service for purposes of building, training, or improving a competing product or service
- Data Mining: Systematically extracting, harvesting, or collecting document templates, AI outputs, or proprietary methodologies
- Benchmarking: Conducting competitive analysis, performance testing, or quality comparisons without prior written consent
- Circumvention: Bypassing, disabling, or interfering with security features, rate limits, access controls, or usage restrictions
- Unauthorized Distribution: Sharing, selling, licensing, or distributing AI Attorney content, documents, or outputs beyond personal use
- AI Training: Using our AI-generated outputs to train, fine-tune, or improve other AI models or systems
4. Account Registration and Security
4.1 Account Requirements
To use certain features, you must register an account with accurate, current, and complete information. You agree to promptly update your account information to maintain accuracy.
4.2 Prohibited Account Use
You may NOT:
- Register using false, misleading, or fraudulent information
- Impersonate any person or entity
- Create multiple accounts to circumvent usage restrictions or trial limitations
- Share account credentials or allow unauthorized access
- Use accounts belonging to competitors for competitive intelligence purposes
4.3 Monitoring and Enforcement
We reserve the right to monitor, flag, restrict, or terminate accounts that:
- Are registered using competitor email domains or IP addresses
- Exhibit suspicious usage patterns consistent with data scraping or reverse engineering
- Generate unusually high API requests or document volumes
- Show evidence of automated access or bot activity
- Violate any provision of these Terms
No refunds will be provided for accounts terminated due to Terms violations.
5. Acceptable Use Policy
5.1 Permitted Use
You may use the Service solely for lawful purposes to generate legal documents for your own personal, professional, or business use, subject to attorney review.
5.2 Prohibited Activities
You agree NOT to:
- Use the Service for any unlawful purpose or in violation of any laws
- Generate documents containing false, fraudulent, or misleading information
- Attempt to gain unauthorized access to our systems, servers, or databases
- Introduce viruses, malware, or harmful code to the Platform
- Interfere with, disrupt, or overload our servers or networks
- Use the Service to harass, abuse, threaten, or harm others
- Violate the intellectual property rights of AI Attorney or any third party
- Engage in any activity that could damage our reputation or business interests
6. Subscription Plans and Billing
6.1 Pricing Tiers
We offer multiple subscription tiers (Single Document, Professional, Business & Firms, Premium Unlimited) with varying features, user limits, and document generation quotas. Pricing is subject to change with 30 days' notice to existing subscribers.
6.2 Billing Terms
- Subscriptions are billed monthly or annually as selected during signup
- Payment is processed automatically via Stripe on your billing date
- All fees are non-refundable except as required by law
- Failed payments may result in immediate service suspension
- You authorize us to charge your payment method for all fees incurred
6.3 Free Trials
Free trials are offered at our discretion and limited to one per user. Trial abuse (creating multiple accounts) will result in immediate termination without refund.
6.4 Cancellation
You may cancel at any time through your account dashboard or Stripe customer portal. Cancellations take effect at the end of your current billing period. No partial refunds are provided.
7. Data Privacy and Security
7.1 Data Collection
We collect information you provide during document generation, including personal information, legal matter details, and usage data. See our Privacy Policy for complete details.
7.2 Data Security
We use industry-standard encryption, secure servers, and access controls to protect your data. However, no system is 100% secure. You acknowledge the inherent security risks of internet transmission.
7.3 AI Provider Data Usage
Your inputs are transmitted to third-party AI providers (Anthropic Claude, Grok/xAI) for processing. While we use enterprise agreements with data protection provisions, you acknowledge these providers process your data according to their own privacy policies.
7.4 Data Retention
We retain your documents and account data for as long as your account is active. Upon account deletion, data is permanently removed within 90 days, subject to legal retention requirements.
8. Document Ownership and License
8.1 Your Documents
You retain ownership of documents generated through the Service and the information you provide. However, you grant us a limited license to use your inputs to generate documents and improve our Service.
8.2 Our License Grant
You grant AI Attorney a worldwide, non-exclusive, royalty-free license to:
- Store and process your data to provide the Service
- Create anonymized, aggregated analytics to improve our AI models
- Display your documents within your account
We will NOT: Share your specific documents publicly, sell your data, or use your documents to train competitor AI models.
9. CrossCheck™ and Precedent Monitor™ Features
9.1 Multi-AI Verification
Our proprietary CrossCheck™ system uses multiple AI models to verify citations, check legal accuracy, and reduce bias. Verification levels (Fast Draft, Standard Research, Verified Premium) offer varying degrees of AI review.
9.2 No Guarantee of Accuracy
IMPORTANT: Despite multi-AI verification, AI Attorney makes NO GUARANTEES regarding:
- Legal accuracy, completeness, or suitability for your specific situation
- Citation validity, currency, or relevance in your jurisdiction
- Compliance with current laws, rules, or court requirements
- Absence of errors, omissions, or AI hallucinations
ALL DOCUMENTS REQUIRE ATTORNEY REVIEW BEFORE USE.
9.3 Precedent Monitor™
Precedent Monitor™ provides legal intelligence alerts about relevant case law and regulatory changes. Alerts are informational only and do not constitute legal advice or comprehensive legal research.
10. Warranties Disclaimer
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
AI ATTORNEY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:
- Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
- Warranties regarding accuracy, reliability, or completeness of documents
- Warranties that the Service will be uninterrupted, secure, or error-free
- Warranties regarding AI-generated content quality or legal sufficiency
- Warranties that documents comply with specific jurisdictional requirements
You assume all risks associated with using AI-generated legal documents. We strongly recommend attorney review of all documents before use in any legal context.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
AI ATTORNEY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
- Lost profits, revenue, or business opportunities
- Legal fees, court costs, or litigation expenses
- Damages from rejected legal documents or failed legal proceedings
- Professional malpractice claims or sanctions
- Data loss, corruption, or unauthorized access
- Reputational harm or emotional distress
OUR TOTAL LIABILITY FOR ALL CLAIMS SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRIOR TO THE CLAIM, OR $100, WHICHEVER IS GREATER.
Some jurisdictions do not allow limitation of liability for consequential damages, so some limitations may not apply to you.
12. Indemnification
You agree to indemnify, defend, and hold harmless AI Attorney, its officers, directors, employees, agents, licensors, and partners from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from:
- Your use or misuse of the Service
- Your violation of these Terms or any law or regulation
- Your violation of any third-party rights, including intellectual property rights
- Any false, fraudulent, or misleading information you provide
- Use of AI-generated documents in legal proceedings without attorney review
- Any claim that your use of the Service caused harm to a third party
- Unauthorized access to the Service through your account
We reserve the right to assume exclusive defense and control of any matter subject to indemnification, at your expense.
13. Termination
13.1 Termination by You
You may terminate your account at any time through your account settings. Upon termination, you will lose access to all features at the end of your current billing period.
13.2 Termination by Us
We may suspend or terminate your account immediately and without notice if:
- You violate any provision of these Terms
- You engage in fraudulent, abusive, or illegal activity
- You use the Service for competitive intelligence or reverse engineering
- Your account exhibits bot, scraper, or automated access patterns
- Your payment method fails or you dispute valid charges
- We are required to do so by law or court order
No refunds will be provided for accounts terminated for Terms violations.
13.3 Effect of Termination
Upon termination, your right to use the Service immediately ceases. We may delete your data after 90 days. Sections 3 (Intellectual Property), 10 (Warranties Disclaimer), 11 (Limitation of Liability), 12 (Indemnification), and 18 (Arbitration) survive termination.
14. Competitor Access Prohibition
SPECIAL RESTRICTIONS FOR COMPETITORS:
If you are employed by, affiliated with, or acting on behalf of a competitor (including but not limited to Harvey AI, Casetext, LegalZoom, Rocket Lawyer, or any company offering AI-powered legal document generation, legal tech software, or related services), you are PROHIBITED from:
- Creating an account or accessing the Service in any capacity
- Using the Service for competitive analysis, benchmarking, or feature comparison
- Accessing the Service through third parties or intermediaries
- Attempting to reverse engineer, replicate, or copy our AI methodologies
- Using our CrossCheck™ or Precedent Monitor™ features to develop competing products
- Extracting, copying, or analyzing our document templates, prompts, or workflows
Violation of this section constitutes a material breach and may result in immediate legal action, including injunctive relief and claims for damages.
15. DMCA and Intellectual Property Enforcement
We take intellectual property rights seriously. If you believe your work has been copied in a way that constitutes copyright infringement, or if you believe our Platform infringes your IP rights, contact us at: legal@aiattorney.app
We will investigate all claims and take appropriate action, including removing infringing content and terminating repeat offenders' accounts.
16. Export Controls and Sanctions Compliance
The Service may be subject to U.S. export control laws and regulations. You represent and warrant that:
- You are not located in a country subject to U.S. embargo
- You are not on any U.S. government list of prohibited or restricted parties
- You will not use the Service in violation of any export laws or regulations
17. Changes to These Terms
We reserve the right to modify these Terms at any time. Material changes will be notified via email or prominent notice on the Platform at least 30 days before taking effect. Continued use after changes constitutes acceptance of the modified Terms.
If you do not agree to modified Terms, your sole remedy is to terminate your account before the effective date of the changes.
18. Binding Arbitration and Class Action Waiver
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.
18.1 Agreement to Arbitrate
You and AI Attorney agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service (collectively, "Disputes") will be resolved by BINDING ARBITRATION, except as specified below.
18.2 Exceptions to Arbitration
The following disputes are NOT subject to arbitration:
- Claims for injunctive or equitable relief to protect intellectual property rights
- Small claims court disputes (if they qualify and remain in small claims court)
- Claims related to violation of Section 14 (Competitor Access Prohibition)
18.3 Arbitration Rules
- Administrator: American Arbitration Association (AAA) under its Commercial Arbitration Rules
- Location: Arbitration will be conducted remotely via video conference, unless both parties agree otherwise
- Costs: Each party bears their own attorneys' fees unless the arbitrator awards fees to the prevailing party
- Discovery: Limited to information directly relevant to the dispute
- Decision: The arbitrator's decision is final and binding, with very limited appeal rights
18.4 CLASS ACTION WAIVER
YOU AND AI ATTORNEY AGREE THAT DISPUTES WILL BE RESOLVED ON AN INDIVIDUAL BASIS ONLY.
YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION, COLLECTIVE ACTION, OR REPRESENTATIVE PROCEEDING. There will be no right or authority for any Disputes to be arbitrated or litigated on a class action basis or in a representative capacity.
18.5 Opt-Out Right
You may opt out of this arbitration agreement by sending written notice tolegal@aiattorney.appwithin 30 days of first accepting these Terms. Your notice must include your name, email address, and a clear statement that you wish to opt out of the arbitration agreement.
18.6 Attorneys' Fees for Frivolous Claims
If you bring a claim that the arbitrator determines is frivolous or brought for an improper purpose (such as harassment or to increase litigation costs), you agree to reimburse AI Attorney for all attorneys' fees and costs incurred in defending against such claim.
19. Governing Law and Jurisdiction
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes not subject to arbitration shall be brought exclusively in the state or federal courts located in Delaware, and you consent to personal jurisdiction there.
20. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.
21. Entire Agreement
These Terms, together with our Privacy Policy and any other legal notices published on the Platform, constitute the entire agreement between you and AI Attorney regarding the Service. These Terms supersede any prior agreements or understandings.
